PHOENIX (AP) - A state appellate court has upheld the Arizona Corporation Commission’s approval of an electric cooperative’s plan to use power that would be generated by a trash incinerator and qualify as renewable energy.
The Court of Appeals on Thursday overturned a trial judge’s ruling that the commission abused its discretion to give renewable energy credits to the Mohave Electric Cooperative for a project planned near Surprise by the Reclamation Power Group.
An environmental group argued that burning trash to produce power was not a use intended under the state’s renewable energy standard, while the commission argued that its decision was entitled to deference by the courts.
The Court of Appeals agreed and said the trial judge erred when he concluded there wasn’t any evidence supporting the commission’s decision.
