ANALYSIS/OPINION:

In our current war with Islamic terrorists, the Obama administration’s justification for holding civil rather than military trials is to demonstrate to the world the fairness of our justice system.

At the same time, this administration also makes clear that any defendant found innocent of all charges will simply go back into the slammer. It’s a bizarre approach, particularly for a supposed “constitutional expert” like President Obama. Given that arrangement, if charged with terrorism (a rather vague term) and given a choice, I’d definitely opt for a military court.
