Doing his best impersonation of an ayatollah, micromanaging New York City Mayor Michael R. Bloomberg issued a fatwa some time ago against big, sugary drinks. A state appellate court just ruled that the ban exceeded municipal legal authority (“NYC appeals court upholds ruling against Mayor Bloomberg’s soda ban,” Web, July 30).

I think we can all agree that obesity is a serious problem, but another serious problem is the attempt by public officials to exceed legal authority in pursuit of anything they consider worthy of authoritarian effort. We see this in unconstitutional recess appointments by President Obama, to mention just one of the president’s recent, unlawful maneuvers.

Mr. Bloomberg reacted to the court’s rebuff in a manner typical of a true believer: He will appeal his fatwa to the state’s highest court.
