DUBUQUE, Iowa (AP) - Iowa’s appeals court has ordered a new resentencing hearing for a man convicted of robbery and shooting a Dubuque police officer.

The Iowa Court of Appeals filed an opinion Wednesday overturning a 50-year prison sentence for Eddie Chest. The judge ordered that prosecutors comply with a 25-year plea deal agreed to in Dubuque District Court.

In 2011, the 76-year-old Chest was sentenced to two consecutive 25-year prison terms for first-degree robbery and attempted murder in the 2009 shooting of Dubuque police Lt. Scott Baxter.

The Telegraph Herald reports (https://bit.ly/1tbhWGp ) Chest agreed to a plea deal if the two sentences ran concurrent. A district judge rejected the agreement. The appeals judges say statements by the assistant Dubuque County attorney during sentencing improperly presented the plea deal.
