CHARLESTON, W.Va. (AP) - A Mercer County magistrate has been appointed to hear a domestic battery case against Kanawha County prosecutor Mark Plants.
The state Supreme Court appointed Magistrate Mike Flanigan to the case Thursday.
Plants was arraigned on the misdemeanor charge earlier this week. He’s accused of hitting one of his sons more than 10 times with a leather belt on Feb. 22. West Virginia State Police began an investigation after Plants’ ex-wife, Allison Plants, reported the incident.

If convicted, Plants faces up to one year in prison and a $500 fine. Plants has said he is not guilty of any criminal misconduct.
No hearing date has been scheduled in the case.
