DOVER, Del. (AP) - A Kent County judge is presiding over the trial of a Newark man charged in the 2010 slaying of a 61-year-old man Smyrna man.

Juan Restrepo-Duque is charged with first-degree murder in the death of Kenton W. Wolf.

Wolf’s body was found in his home after co-workers called police when he failed to show up for work.

Restrepo-Duque, who was 18 at the time of the slaying, reportedly told investigators that the two men were drinking beer in Wolf’s bedroom when Wolf made a sexual advance.

Restrepo-Duque allegedly grabbed a knife on a night stand next to the bed, cut Wolf’s throat and stabbed him repeatedly, according to a police affidavit.

The judge in the case last year denied a defense request to prohibit prosecutors from seeking the death penalty.
