MILFORD, Neb. (AP) - The brother of Milford Mayor Dean Bruha has sued him over financial dealings that police have cited in criminal charges against the town leader.

Robert Bruha is seeking more than $47,000 in damages and other costs from Dean Bruha in a lawsuit filed Monday in Seward County Court, the Lincoln Journal Star (https://bit.ly/19YQmpv) said.

Dean Bruha didn’t immediately return a call Tuesday from The Associated Press.

The lawsuit says Robert Bruha had given his brother access to his checking account solely to pay Robert Bruha’s bills, taxes and other expenses. But, the lawsuit says, Dean Bruha opened several credit card accounts in Robert Bruha’s name without is permission. The lawsuit says Dean Bruha then used money from his brother’s checking account to make payments on the credit cards and also wrote checks to himself totaling more than $27,000.

It’s unclear why Robert Bruha gave his brother access to his finances. Robert Bruha and his attorney didn’t immediately return calls from the AP.

The lawsuit says the various financial dealings took place between January 2008 and December 2012 and that Dean Bruha breached his fiduciary responsibility over that time by using this brother’s money for personal gain.

Robert Bruha says in the lawsuit that he confronted his brother and demanded restitution. The lawsuit says Dean Bruha paid his brother back $10,000 but still owes about $46,000.

Dean Bruha has already pleaded not guilty to several felony criminal charges: identity theft, theft and eight counts of forgery. His trial is scheduled to begin March 18.
