PATERSON, N.J. (AP) - One of the men charged in the death of a 12-year-old girl who was killed by a stray bullet while riding a scooter in northern New Jersey is due in court.

An initial appearance is scheduled for 21-year-old Jeffery Ellerbee on Tuesday. He’s the second young man charged with first-degree murder and weapons offenses in the death of Genesis Rincon.

The girl was struck in the head on July 5 as she rode home to a family gathering in Paterson. She was kept on life support for several days until her organs were donated.



Prosecutors also charged 19-year-old Jhymiere Moore with murder. He’s pleaded not guilty.

A third man, 19-year-old Marshae Anthony, is charged with weapons offenses in the case.

Prosecutors have said Rincon was not the intended target.
