FORT SMITH, Ark. (AP) - The Sebastian County prosecutor says he won’t file criminal charges in the fatal shooting of a man at a Fort Smith mall earlier this month.

Prosecuting attorney Dan Shue said Monday that Grayson Herrera was justified in the May 11 shooting of 34-year-old Fadi Qandil. According to the Southwest Times Record (https://bit.ly/1sMARVd ) prosecutors determined the shooting was a justifiable homicide that did not merit the filing of criminal charges.

Shue says Qandil pulled a gun from his waistband and began firing at a group of people that included his estranged wife. Herrera, who has a concealed-carry license, returned fire and fatally shot Qandil.

Authorities say Herrera was wounded in the shootout.

Shue says the investigation found that Qandil was using “unlawful deadly physical force” and that Herrera was defending himself.
