CLEVELAND (AP) - A Cleveland man charged with fatally shooting his 12-year-old stepdaughter and wounding his wife has been indicted on aggravated murder and attempted murder charges.

A Cuyahoga (ky-uh-HOH’-guh) County grand jury returned the indictment on Monday against 59-year-old Rufus Gray. Authorities say Gray broke into his estranged wife’s home on Oct. 30 and began shooting, killing Davia Garth and wounding her mother. Forty-five-year-old Sonya Garth filed for divorce against Gray in April.

Sonya Garth’s 24-year-old son wrested the gun away from Gray.

Prosecutors say Gray was previously convicted of felony domestic violence involving Sonya Garth and pleaded guilty to voluntary manslaughter in 1989 after killing a Cuyahoga Metropolitan Housing Authority guard who had tried to break up a fight.

Court records indicate that Gray does not have an attorney.
