SOUTH BEND, Ind. (AP) - A northern Indiana woman’s lawyer is seeking the dismissal of a feticide charge she faces in the death of her baby whose body was found in a restaurant trash bin.

The defense attorney for 33-year-old Purvi Patel of Granger also argues in a court filing that investigators improperly questioned her in a hospital without reminding her of her legal rights.

Patel also faces child neglect charges over the death of the infant, whose body was found outside a Mishawaka restaurant in July 2013. Court documents say Patel told doctors the baby was stillborn, but a pathologist ruled the infant was born alive.

The South Bend Tribune reports (https://bit.ly/1uif7oC ) defense attorney Jeff Sanford also wants the judge to not allow images of the baby in the trash bin during Patel’s trial.
