PENDLETON, Ore. (AP) - A grand jury has cleared a state corrections officer in the shooting of an inmate in August.

Authorities say the guard shot one of two inmates who were attacking a third inmate.

Umatilla County District Attorney Dan Primus told the East Oregonian (https://bit.ly/1vx55BJ) he presented the case to a grand jury Thursday, and the jury found the officer justified in using deadly force.



The guard has not been named.

A 26-year-old inmate, Jayson Matthew Withers, was killed.

The grand jury indicted the second prisoner, 22-year-old Cameron Hayes, on an assault charge.

Primus said they were attacking 46-year-old Eric Dean Sexton.
