SAVANNAH, Ga. (AP) - Prosecutors in Savannah say a witness’ refusal to testify in a murder trial has left them and the victim’s family feeling that justice hasn’t been served in the case.

Superior Court Judge Michael Karpf ordered an acquittal Wednesday for 23-year-old Izell Marketh Perry, who was accused in the March 2013 shooting death of 32-year-old Sidney Grant outside a nightclub.
Authorities say John Antonio Smith was the only witness who identified Perry as the shooter, but refused to answer questions in court last week.
The judge sentenced Smith to 280 days for contempt of court.
