NEW YORK (AP) - A judge has ruled that the family of a Long Island murder victim can sue the psychologist who treated the convicted killer and the residential facility that released him before the slaying.
Evan Marshall, of Glen Cove, is serving 30 years-to-life in prison for the killing and dismemberment of Denice Fox in 2006.
The family alleges that releasing Marshall from a mental health/drug abuse treatment program was “wholly inappropriate” because of his past violent history.
Marshall was a patient at a facility in Brewster that was run by SLS Residential Inc.
The attorney for SLS Residential tells Newsday (https://nwsdy.li/1uvEulg ) he has complete confidence that whatever claims remained against his client would be dismissed.
The attorney for the psychologist couldn’t be reached Tuesday.
