JACKSON, Miss. (AP) - The state Court of Appeals has denied a new trial to Darrell Brooks who was sentenced to life without parole for the fatal shooting of a Gulfport man in 2009.

Brooks was convicted of murder in Harrison County in 2011. Authorities say 29-year-old David Shivers Jr. was fatally shot Dec. 7, 2009, in his family’s home in Gulfport.

Brooks argued there was no physical evidence or eyewitnesses linking him to the crime.

The Appeals Court said Tuesday there was evidence that Brooks had threatened to kill Shivers and had followed his estranged wife who was dating Shivers. The court said Brooks tried to obtain a gun from two people and two witnesses testified that Brooks wanted to use them as an alibi for the night of Shivers’ death.
