NOVATO, Calif. (AP) - A Marin County commission’s decision to rehire a sheriff’s deputy who was fired after he shot a motorist is not sitting well with the sheriff.

The Marin Independent Journal reports (https://bayareane.ws/1IEPp5x) that Sheriff Robert Doyle is considering appealing the Personnel Commission’s decision to bring back Evan Kubota. The commission voted 3-2 earlier this month in favor of Kubota’s return although they demoted him to a civilian role in the sheriff’s office.

Doyle fired Kubota, accusing him of violating the department’s use-of-force policy when he fired 16 bullets at a misdemeanor suspect’s car on a busy Marin City street last year.

The motorist has filed a $10 million lawsuit against the county.

Kubota’s attorney, Julia Fox, has called the commission decision a “win.” The commission rejected findings that Kubota violated the sheriff’s office’s use of force and use of firearms policies.
