MIAMI (AP) - A dustup over a multimillion-dollar mistake in the value of a diamond purchased aboard a cruise ship is headed back to a Miami courtroom.
The 3rd District Court of Appeal ruled that a lower court judge erroneously tossed out the case. That means Thomas DePrince gets a new chance to argue that his 2013 purchase of a 20-plus-carat diamond for $235,000 should stand.
DePrince arranged to buy the loose diamond while at a Holland America Line onboard jewelry shop. The shop belatedly realized the price should have been $235,000 per carat - or about $4.8 million.
The sale was halted and money refunded, leading to DePrince’s lawsuit claiming a deal is a deal. DePrince is a retired jewelry and antique shop owner who was warned the price was too low.
