MASON CITY, Iowa (AP) - A Mason City man has given up his effort to get his 25-year prison sentence for vehicular homicide overturned.
The Mason City Globe Gazette reports (https://bit.ly/1G5UDXi ) that a court on Friday granted 36-year-old Jason Glenn Genzler’s request to dismiss his petition.
Genzler had filed the petition for post-conviction relief in Cerro Gordo County District Court, asking a judge to overturn his conviction and sentence for the 2012 death of 33-year-old John Lybarger.
A judge had been scheduled to hear his arguments on April 22.
Police say Genzler was drunk when the pickup he was driving went out of control and rolled, killing Lybarger.
