MARTINSBURG, W.Va. (AP) - Prosecutors plan to retry a former Berkeley County deputy on an embezzlement charge following a mistrial.

Media outlets report that a Berkeley County Circuit Court jury found 54-year-old Dennis Streets not guilty of fraudulent scheme last week. But the jury deadlocked on the embezzlement charge.

Circuit Judge John Yoder declared a mistrial on the embezzlement charge and set a status hearing for April 30.

Berkeley County assistant prosecutor Timothy D. Helman says he understands the jury’s decision on the fraudulent scheme charge. He says he intends to retry Sheets on the other charge.

Sheets was accused of taking more than $5,000 worth of guns from the sheriff’s office.
