LANCASTER, N.H. (AP) - The stepfather of a girl who was taken out of the United States a decade ago amid a custody dispute has been indicted in New Hampshire.

Scott Kelley is the second husband of Genevieve Kelley, who fled with her then-8-year-old daughter in 2004.

State officials said Monday that Scott Kelley was indicted on custodial interference and witness tampering charges, the same faced by Genevieve Kelley. The witness tampering charge says they made the now-19-year-old daughter unavailable for a court-ordered evaluation by leaving the country.

Scott Kelley was arrested Wednesday in Atlanta after he and the daughter, Mary Nunes, arrived on a flight from Costa Rica. He’s scheduled to be arraigned next month.

A lawyer representing Genevieve Kelley hasn’t replied to a request for comment.

Genevieve Kelley’s trial is scheduled for next month.
