CHARLESTON, W.Va. (AP) - A judge has dismissed a lawsuit alleging a Charleston abortion provider ignored a woman’s wishes to stop the procedure.

The lawsuit also alleged that the doctor left the fetus’ head inside the woman’s uterus.

The Charleston Gazette (https://bit.ly/1Gik1sW ) reports that Kanawha County Circuit Court Judge Joanna Tabit dismissed the lawsuit against the Women’s Health Center of West Virginia on Monday.

The Family Policy Council of West Virginia filed the lawsuit in 2013 on behalf of Itai Gravely of Charleston. Graveley had the abortion in 2012.

In her ruling, Tabit said Graveley testified that she didn’t suffer any physical injury as a result of the abortion.
