Police decided not to file charges against a man who fatally shot his brother during an argument outside a Milwaukee restaurant.

Police said 46-year-old Rodney Jones was shot and killed by his 36-year-old brother outside the Bungalow Restaurant located near North 24th and Keefe Avenue on Saturday, The Associated Press reported.

Milwaukee police said Jones and his younger brother, who is the restaurant’s manager, got into a heated argument that turned physical when he was shot. The district attorney determined the younger man acted in self-defense when he shot Jones.

Police did not name the brother who shot Jones, but said he was the manager of the restaurant and remained on the scene and cooperated with police in the investigation.

Another restaurant employee told police that the younger brother was trying to protect his parents during the incident, AP reported.
