JACKSON, Miss. (AP) - The Mississippi Supreme Court will hear an appeal from Eric Wallace, a paralyzed Warren County man convicted in a 2011 drive-by shooting.
The court, in a 5-4 order Thursday, granted Wallace’s motion to hear his arguments.
Wallace, now 34, was paralyzed following a drive by shooting in 2006. He is serving a 23year prison sentence for drive by shooting, shooting into a motor vehicle and shooting into a dwelling.
Wallace’s conviction was upheld by the state Court of Appeals in 2014.
Prosecutors say Wallace shot at a car and at the front door of an unoccupied home in 2011. No one was hurt.
Prosecutors say bullet casings found at the scene matched Wallace’s pistol.
Wallace argued the markings on the shell casings were not enough to convict him
