BOZEMAN, Mont. (AP) - Gallatin County prosecutors have reduced two charges filed against a Bozeman man after a September 2013 shooting that left one man dead and another injured.

The Bozeman Daily Chronicle reports (https://bit.ly/1Hc7pRF ) County Attorney Marty Lambert maintained the deliberate homicide charge against Cody Christopher Little in the shooting death of 24-year-old Larry Clayton of Belgrade.

However, he reduced two counts of attempted deliberate homicide to aggravated assault and assault with a weapon. One man was shot in the leg and another said Little pointed a shotgun at his face and pulled the trigger. The gun did not fire.

Defense attorneys argued the shooting death should have been charged as mitigated deliberate homicide, but they believe the other charges reflect how the case should have been charged.

Little has not entered a plea on the new charges. His trial is scheduled to start on May 27.
