ATHENS, Ohio (AP) - An appeals court has denied a former southeast Ohio sheriff’s request to be released from prison while he challenges his public corruption conviction.

The Athens Messenger reports Tuesday (https://bit.ly/1IyuO1g ) the 4th Ohio District Court of Appeals ruled 2-1 late last week to keep former Athens County Sheriff Patrick Kelly in jail.

Kelly was convicted in February of engaging in a pattern of corrupt activities, theft in office, perjury and other charges. He was later sentenced to seven years in prison. His attorney requested that the sentence be suspended pending a decision in the appeals case.

Kelly’s attorney Scott Wood had argued that Kelly posed no flight risk, but the judges voting down the request wrote that Kelly’s past demonstrated he wouldn’t abide by orders and conditions set by the court.
