DES MOINES, Iowa (AP) - A prosecutor has moved to drop the first-degree murder charge against a man accused of fatally shooting a woman in a Des Moines apartment building last year.

The motion filed Monday would dismiss the case against 24-year-old LB Goodjoint, who was arrested in September in connection with the May 2014 death of 19-year-old Ameisha Heard.

Online court records show a judge hasn’t yet ruled on the request, and the Des Moines Register reports (https://dmreg.co/1K4l15b ) Goodjoint remained in the Polk County Jail as of Tuesday morning.

The motion calls for further investigation and says there isn’t sufficient evidence to prove Goodjoint was involved in Heard’s killing based on witness testimony.

Goodjoint had been scheduled to go to trial on May 18.
