DES MOINES, Iowa (AP) - A judge has dropped a murder charge filed against a man accused of killing a 19-year-old Des Moines woman last year.

On Tuesday Judge Richard Blane dismissed the first-degree murder charge facing 24-year-old LB Goodjoint, who was charged with the May 7, 2014, shooting death of Ameisha Heard. Goodjoint’s trial was scheduled to begin next week. He left the Polk County Jail on Tuesday evening.

On Monday a prosecutor filed a motion to dismiss the charge. Prosecutors have said witnesses who were cooperative soon after the shooting have stopped cooperating. The motion says there isn’t sufficient evidence to prove Goodjoint was involved in Heard’s killing.

The charge was dismissed without prejudice, so the state can file another case against Goodjoint based on the same assertions.
