DENVER (AP) - Prosecutors are deciding whether to charge a man with Douglas Kubo’s death this month from complications related to a 2003 gunshot wound.

The Denver Post reports (https://dpo.st/1JMJed2) 62-year-old Edward Herrera is serving a life sentence after being convicted of four murder counts stemming from a 2003 home invasion he committed with is son, who pleaded guilty to armed robbery and was recently paroled.

Douglas Kubo was the fifth victim in the robbery, and suffered an aneurism from a gunshot wound to the neck that fractured two vertebrae. His death last month was ruled a homicide by Denver’s medical examiner.

District attorney spokeswoman Lynn Kimbrough says prosecutors need to determine if they can legally charge Herrera, decide how they’d build the case so many years later, and consult the victim’s family.
