GRAPEVINE, Texas (AP) - A grand jury has declined to indict a Dallas-area officer in the fatal shooting of an unarmed man during a traffic stop captured on patrol car video.

Grapevine police and prosecutors on Monday announced Officer Robert Clark will not face charges in the death of Ruben Garcia Villalpando, a Mexican national.

Chief Eddie Salame (SAHL’-uh-may) says Garcia was legally intoxicated during the Feb. 20 incident.

Police say Clark chased Garcia’s car until the vehicle stopped in Euless (YOO’-lihs) after a pursuit with speeds of nearly 90 mph.

The video shows the driver getting out with his hands up, then on his head as the officer yells numerous times not to approach him. The driver eventually is no longer seen on video as he walks toward the officer, who opens fire.

Mexico’s Foreign Relations Department says the Mexican Consulate will assist Villalpando’s family in a lawsuit.
