TUCSON, Ariz. (AP) - A Tohono O’odham man has been acquitted of assaulting a U.S. Border Patrol agent with a pickup truck.

Shawn Miguel was accused of hitting a parked Border Patrol vehicle last year.

The 36-year-old San Miguel Village resident faced up to 20 years in prison for assault on a federal officer with a deadly weapon.

Miguel’s first trial ended in a hung jury last month in U.S. District Court in Tucson.

The Arizona Daily Star reports (https://bit.ly/1FC7eSv) Miguel was acquitted Wednesday after his second trial.

Defense lawyers say Miguel hit the Border Patrol truck by accident as he was trying to avoid running into a tree on March 31, 2014.

Miguel reportedly had been drinking and smoking marijuana before going for a ride that night in his mother’s truck.
