BURLINGTON, Iowa (AP) - Despite an Illinois man’s guilty plea to one charge stemming from the death of a toddler at an Iowa motel, all charges against him have been dropped.
The Hawk Eye reports (https://bit.ly/1ekykkP ) that a charge of leaving the scene of the fatal accident was dismissed Wednesday for 35-year-old Phillip Evans, of Wood River. He’d pleaded guilty in January, but a judge set aside the plea after learning Evans couldn’t say he had any knowledge of his truck striking the child. Evans admitted leaving the Burlington scene but denied that he’d struck 2-year-old Dniyah Angelique Noel Brider the night of May 10 last year.
A charge of vehicular homicide was dropped because prosecutors couldn’t prove Evans’ blood alcohol level was above the limit at the time of the accident.
