SAN JOSE, Calif. (AP) - Prosecutors say that a San Jose State University police sergeant won’t be criminally prosecuted for fatally shooting a 38-year-old man armed with a blade on the edge of campus last year.

The Santa Clara County District Attorney’s Office said Friday prosecutors concluded Sgt. Mike Santos lawfully shot and killed a man who was rushing at a fellow officer while holding a 12-inch blade in his hand.

Prosecutors say that during the incident on February 21, 2014 on the edge of campus, the two officers had already ordered the erratically-acting Antonio Guzman-Lopez to drop his weapon and fired a Taser at him, to no effect.

In a 46-page report, prosecutor Matthew Braker determined that the veteran officer shot Guzman-Lopez while fearing for the safety of his fellow officer.
