DAYTONA BEACH, Fla. (AP) - A sheriff’s deputy has been cleared in the death of a man who pulled a gun from his pocket at a towing company.
According to a Florida Department of Law Enforcement report, Volusia County Sheriff’s Deputy Joel Hernandez shot 52-year-old Edward P. Miller four times Sept. 20 at Fryer’s Towing in Daytona Beach.
State Attorney R.J. Larizza said Friday that no criminal charges would be filed against Hernandez.
The deputy told investigators that he approached Miller’s car in plainclothes with his badge on his belt after employees said Miller threatened them. Miller was hearing impaired, and Hernandez told investigators that he thought Miller might be drunk because he was yelling incomprehensively.
Miller’s family tells the Daytona Beach News-Journal (https://bit.ly/1cTsyWp ) that they will take legal action against the sheriff’s office.
