MCKEE, Ky. (AP) - The insurance carrier for the former Jackson County sheriff has agreed to a $62,500 settlement in a false-arrest lawsuit by a former Jackson County judge-executive.
The lawsuit followed William O. Smith’s January 2014 arrest by then-Sheriff Denny Peyman on charges that included tampering with public records and forgery.
Peyman said he based the charges on a 2011 audit. He filed the charges on his own, without obtaining a warrant from a judge or an indictment from a grand jury. The charges were quickly dismissed.
An attorney representing Smith told The Lexington Herald-Leader (https://bit.ly/1AqsKHD) the settlement was reached on Thursday following mediation.
Peyman’s attorney said the former sheriff did not admit wrongdoing as part of the settlement.
Peyman’s insurance carrier, the Kentucky Association of Counties, agreed to the settlement.
