CANANDAIGUA, N.Y. (AP) - A former upstate New York police officer accused of having a small marijuana grow operation inside his home has had his felony charge reduced to a misdemeanor.

The defense attorney for Wayne Fenton requested that the marijuana allegedly found last June at Fenton’s Canandaigua home be re-weighed after the reported weight of the drug nearly tripled from the time it was weighed by law enforcement in the Finger Lakes city to the time it was measured by the Monroe County Crime Lab.

Court documents show the amount seized weighed 3.7 ounces initially, but came back from the crime lab weighing 9.795 ounces.

WHEC-TV in Rochester reports the re-weighing totaled 3.44 ounces.

The legal threshold for a felony criminal possession of marijuana charge is 8 ounces.
