BATON ROUGE, La. (AP) - Deputies say an 8-year-old Baton Rouge boy shot his 17-year-old brother as the teen was playing a video game earlier this month.

On Tuesday, East Baton Rouge Parish sheriff’s deputies arrested the adult who was supervising the child at the time of the shooting.

The Advocate reports 23-year-old Robert Payne was booked with child desertion and negligent injuring.

Sheriff’s deputies say the May 15 shooting shattered the teen’s spine and he’s paralyzed from the waist down.

Online jail records did not list an attorney for Payne.
