ROCHESTER, N.Y. (AP) - The father of a bicyclist who was killed after she collided with a Rochester bus last year is suing the transit authority.

The Rochester Democrat and Chronicle reports (https://on.rocne.ws/1JWnq0W ) Leoncio Rodriguez filed suit after his 40-year-old daughter was killed in January 2014. Authorities say Yesenia Rodriguez collided with a Regional Transit Service bus and was killed.

Police said at the time it appeared the woman veered into the path of the bus. The father’s attorney, Michael Cobbs, says it would be against human nature to “veer into the path of a 5-ton bus.”

Cobbs says they think the driver didn’t see the bike properly.

The suit names Regional Transit Service and the driver of the bus involved as defendants.

A transit authority spokeswoman didn’t comment on the litigation.
