NEW YORK (AP) - The Brooklyn district attorney has decided not to file charges against a retired correction officer who fatally shot a man during a confrontation at a subway station.

Authorities say the dispute began when the victim, 32-year-old Gilbert Drogheo, and another man started bothering 69-year-old William Groomes on a subway train March 10.

The confrontation escalated when the three got off the train at Borough Hall Station and Groomes shot Drogheo during a scuffle.



The Daily News (https://nydn.us/1btwZGp ) says Groomes told investigators he was trying to arrest Drogheo. The other man was charged with assault.

Defense lawyer Peter Troxler said Monday “Groomes was elated that the justice system performed as he had hoped.”
