IDAHO FALLS, Idaho (AP) - An Idaho Falls man who was shot by police officers in June has been sentenced to jail for punching his girlfriend.
The Post Register reports (https://bit.ly/1jqZ3Pw ) that Magistrate Judge Mark Riddoch sentenced 31-year-old Ricky Mosley to local jail time on Monday.
Mosely pleaded guilty to misdemeanor charges and will serve 60 more days in Bonneville County Jail followed by two years of supervised probation. He will also have to complete treatment for domestic violence and substance abuse.
He was hospitalized for about three months after being shot by Bonneville County Sheriff’s Office deputies and Idaho Falls Police officers in June.
In early August, Bonneville County Prosecuting Attorney Daniel Clark said that the deputies and police officers were justified in their use of deadly force.
Sheriff’s deputies Nicholas Contreras, Austin Flegel and Christopher Rix, and Idaho Falls police officers Bart Whiting and Daniel Godfrey were all at the scene when Mosley was shot.
Mosley was pulled over at a gas station by authorities responding to a domestic violence report. Clark said Mosely had his hands in a shooting position while he held a cellphone that officers thought was a weapon. The deputies and officers then fired at Mosley, hitting him five times.
According to court records, Mosley became angry earlier that day when a child woke him up. Authorities say Mosley argued with the 26-year-old victim until she said she was leaving for the night.
Court documents say that Mosley then punched the pregnant woman in her stomach and repeatedly in the face. When she got into her car, Mosely head-butted the passenger side window and broke it.
He fled after neighbor’s called authorities, but was pulled over by police, leading to the shooting.
