BOISE, Idaho (AP) - A judge has ruled that a Boise man convicted of murder in his infant daughter’s 2010 death was found guilty based on substantial evidence, denying a Boise man’s request for a new trial in the case.
The Idaho Statesman reports (https://bit.ly/1JbG2Fm) 4th District Judge Patrick Owen said he found no justification for setting aside 55-year-old Jeffery Baker’s 2013 murder conviction.
Baker was found guilty of first-degree murder after being accused of violently shaking his 11-week-old daughter, Gracelynn, and causing her death. He was sentenced to 15 years to life in prison.
Baker’s attorney had argued that the jury unfairly ruled out that Gracelynn may have died from other causes. In Owen’s decision, he cited the prosecution’s experts who all agreed that Gracelynn’s death was caused by a nonaccidental head injury.
