FREEPORT, Texas (AP) - Authorities say a man has been charged with attempted capital murder of a peace officer after firing a gun at a Southeast Texas sheriff’s deputy whose bulletproof vest stopped the bullet.

The Brazoria County sheriff’s office says Deputy Brian Harper was dispatched Saturday to a report of a suspicious person in Freeport.

Authorities say as Harper checked 26-year-old Brian Spinks for weapons, Spinks started to pull away. When Harper took Spinks to the ground to control him, Spinks pulled a handgun and shot Harper.

Authorities say Harper then gained control of the handgun and Spinks tried to run, but citizens helped restrain Spinks.

Harper was taken to a hospital and later released.

Spinks was in jail Sunday on $1 million bond. Jail records don’t list an attorney for him.
