WASHINGTON, Pa. (AP) - A judge has denied a defense request to exclude from trial a statement in which state police allege that a western Pennsylvania man admitted that he killed his brother.
Forty-eight-year-old Robert Bauduin of Jefferson Township is charged with homicide in Washington County in the November 2013 shooting death of 47-year-old Richard Bauduin of Colliers, West Virginia.
The (Washington) Observer-Reporter (https://bit.ly/1X6wK6I ) reports that Bauduin’s public defender argued that police knew Bauduin was intoxicated when they interviewed him.
But Judge John DiSalle ruled Thursday that Bauduin still “had sufficient mental capacity” when he volunteered the information. The judge said video from the interview shows that the defendant was able to remember details of the shooting, and he conversed clearly with a 911 operator. Jury selection is scheduled to begin April 11.
