COLORADO SPRINGS, Colo. (AP) - A driver who investigators say was drunk and racing another vehicle when he hit and killed a man with his car in Colorado Springs has been sentenced to five years in prison.
The Gazette reports (https://goo.gl/G3YUSv ) 22-year-old John Marvel was sentenced Wednesday for the July 25 crash that killed 22-year-old Andrew Shada. Marvel pleaded guilty in January to vehicular homicide as a result of drunken driving.
According to an arrest affidavit, he ran off the road and struck Shada outside a home. Investigators say Marvel’s blood alcohol content was 0.133 percent at the time.
The legal limit for driving is 0.08 percent.
Wednesday’s sentence came only days after Marvel’s co-defendant was acquitted of vehicular homicide. His attorney said he was not racing Marvel but following him to make sure he got home OK.
