HAMILTON, Ohio (AP) - The trial of a man accused of fatally beating his girlfriend’s 2-year-old daughter is postponed while a visiting judge hears a defense motion to dismiss charges against the man.

Court officials confirm the Butler County trial judge determined Thursday that it wouldn’t be appropriate for him to hear a motion involving recordings between Bradley Young and his attorney. Young’s attorneys say the charges should be dropped because Young’s constitutional rights were violated when his attorney-client phone calls at a southwest Ohio jail were recorded.

Young has pleaded not guilty to murder and other charges in Kinsley Kinner’s death in December. No new date has been scheduled for his trial that had been set to begin Monday.

The county prosecutor says there has been no wrong-doing in the case.
