BISMARCK, N.D. (AP) - The Bismarck Police Department says an officer has returned to regular duty after the McLean County State’s Attorney determined that a January shooting of a suspect was justified.

McLean County States Attorney Ladd Erickson said that he had found Sgt. Jordan West’s actions justified.

Eighteen-year-old Miguel Stubing of Mandan was shot by West on Jan. 23 after allegedly ignoring verbal commands and driving toward West, who was responding to reports of a vehicle stolen out of Mandan.

Court documents show West fired five times at the vehicle to protect himself. The vehicle fled the scene and was later stopped by officers in Emmons County.

Stubing has pleaded not guilty to charges.
