PHILADELPHIA (AP) - A Philadelphia judge has dismissed a juror on the fifth day of deliberations in the retrial of a man accused of having set a fire that killed his two young sons three decades ago.

The Philadelphia Inquirer (https://bit.ly/1Yf6qaG ) reports that the unidentified juror had told other members of the panel that they were “going to cause her to have a nervous breakdown.”

The note said the juror was hyperventilating and “popping pills.” Another note said jurors were deadlocked on the arson charge.

An alternate juror was being recalled for deliberations in the retrial of 56-year-old Daniel Dougherty, who was originally sentenced to death in the 1985 deaths of 4-year-old Daniel and 3-year-old John. He won a new trial after an appeals court said his lawyer was ineffective.
