NEWARK, N.J. (AP) - The defense attorney for a suspended Newark Fire Department Captain accused of impersonating a law enforcement officer says her client maintains his innocence and claims that the charges are part of the city’s ongoing retaliation against him.

NJ.com reports (https://bit.ly/1XkMXoT ) Tisha Adams made the remarks Thursday after attending a hearing on the city’s motion to dismiss a lawsuit levied against it by 47-year-old Anthony Graves.

Prosecutors say Graves activated the emergency lights in his fire department vehicle and verbally questioned two motorists in 2014.

Graves had filed a lawsuit against the city and various municipal officials claiming that he had been a victim of retaliation and racial discrimination. The city says in its motion to dismiss that Graves’ claims don’t constitute retaliation.

A judge on Thursday denied the city’s motion.
