RALEIGH, N.C. (AP) - The North Carolina Court of Appeals has ruled that a lawsuit filed against an Asheville hotel in the wake of a Charlotte woman’s drinking death can move forward.

The Asheville Citizen-Times (https://avlne.ws/1PWL77Y ) reports a three-member panel of the Court of Appeals ruled 2-1 Tuesday to reverse a Mecklenburg County Superior Court decision.

The ruling means the estate of 50-year-old Lisa Mary Davis can pursue its claim that companies that own and run the Crowne Plaza Resort were negligent in serving her at least 10 drinks on the night of her 10th wedding anniversary in 2012. Her husband found her dead on the floor the next morning.



The ruling says a plaintiff’s negligence doesn’t mean they cannot win damages in cases of “gross negligence.”

The resort will appeal the decision to the state Supreme Court.
