MCALESTER, Okla. (AP) - Charges have been dropped against a man accused of flying a drone that carried cellphones, drugs and weapons into the Oklahoma State Penitentiary.

The Oklahoman (https://bit.ly/1qxQhCw ) reports that 30-year-old Marquis Gilkey was arrested and charged Nov. 4 with attempting to bring contraband into a penal institution, conspiracy, kidnapping and a gang-related offense.

Gilkey’s attorney said the charges were dropped after a disagreement about the identity of the suspect.

An unidentified woman told investigators that Gilkey kidnapped her and made her participate in a gang-related plot to sneak contraband into the maximum security facility. She said the two tried to fly the drone over prison walls in the middle of the night from a nearby home’s backyard.

Correctional officers found the drone caught on the fence’s razor wire the next morning.
