EL PASO, Texas (AP) - A mistrial has been declared after a West Texas jury could not reach a verdict in the case of a former soldier accused in the death of an off-duty constable working security at a Halloween haunted house.
The El Paso Times (https://bit.ly/2hJe3Lq ) reports 21-year-old Devon Huerta-Person will remain free on bond until prosecutors decide if he will be retried following Friday’s mistrial.
Huerta-Person is facing one count of aggravated assault on a public servant in the 2014 death of Constable Robert White.
Authorities say White had been working security at an El Paso-area haunted house when he was punched in the face and fell to the ground.
The 45-year-old constable died at a hospital. According to court documents and trial testimony, the assault might have triggered a fatal heart attack.
